TERMS OF SERVICE:
Please read this agreement before becoming a highly valued HitzTraffic.com Client By using any of our services, you hereby certify that you have read and agree to the following terms of service:
Please read the entire agreement which ends with the text - END OF AGREEMENT.
This is a legal agreement between you (purchaser) and HitzTraffic.com This agreement concerns your purchase of a service in which HitzTraffic.com agrees to send visitors to a URL specified by you ("the service" or "the package"). This traffic agreement applies to either Mainstream Internet Traffic or Adult Internet Traffic.
GUARANTEE:
You are guaranteed that HitzTraffic.com will send the number of targeted visitors to the URL you specify upon receipt of your payment, but we can not guarantee that visitors will turn into buyers. Your ability to convert sales depends on the content and overall presentation of your site.
REFUND POLICY:
If HitzTraffic.com is unable to deliver the number of visitors promised, you may claim a refund on pro-rata basis.
In the unlikely event that we cannot deliver the number of visitors promised, we will provide a refund of your entire purchase price on a pro-rata basis. In cases where refunds are claimed, we reserve the right to require proof that the proper number of visitors were not delivered. Stats, data and other information from third party counters are not sufficient to establish a claim. These counting systems tend to yield an improper count. If we dispute your claim, you must provide us with RAW server logs from the site and time period in question - this is the only reliable method of counting a visitor.
THIRD PARTY STATS:
Our stats are the only stats we will accept disputes from. There are many reasons that a visitor will not register with your server and your count shows more or less visitors.
* A user cancels out the window before your site loads
* The user is on a slow connection and the request times out
* The user is behind an ISP with a proxy ex. AOL, Earthlink, MSN
* The user's browser served the request from cache instead of from your server
* Your site was unavailable at the time of request
* You are using a 3rd party counter not running on your sites server (like free counters)
* Your tracking software could not handle all the concurrent connections
* You have traffic coming from other sources
POP UP POLICY
HitzTraffic.com cannot deliver visitors to sites with popup windows unless the service ordered allows this option. Any additional window generated by your site shall be considered a popup window, including pop-under windows and java script alert windows. If a popup window is installed on the URL at any time, HitzTraffic.com may stop the campaign and you will not be entitled to a refund.
ADULT/CASINO TRAFFIC:
HitzTraffic.com will deliver visitors to Adult and Casino websites. This type traffic must be purchased as Adult/Casino traffic. Anyone caught using a redirect script or other means to divert traffic to another website, will forfeit the traffic not delivered and there will be no refund of any kind. Anyone diverting traffic to hate text, illegal content (in the US) and content that encourages illegal activities or violence will forfeit the traffic not delivered and there will be no refund of any kind. What constitutes inappropriate content shall be determined at the sole discretion of HitzTraffic.com
We will review your site before beginning the campaign. If your site is changed during the campaign such that it includes inappropriate content, we may stop your campaign immediately. In this case, we will not provide a refund on a pro-rata basis.
PAYMENT LIABILITY:
HitzTraffic.com reserves the right to hold Customer and any agency, broker or other authorized representative of Customer jointly and severally liable for all amounts owed to HitzTraffic.com
OTHER LIMITATIONS:
HitzTraffic.com cannot be held responsible for factors beyond our control that may interfere with our ability to deliver visitors to your URL. Such factors include, but are not limited to: downtime on your server, overuse of your bandwidth quota (if applicable), errors on your site and network outages beyond our servers. Please contact your web hosting company or network provider if you are unsure about whether your hosting account is sufficient for the program you are ordering.
